从Owen的Blog中得知了Robot Co-op推出的新服务43places,马上加了这个参与测试的目标,并进行了测试。 如果使用过43things的服务的话,对于43places的界面就一点都不会陌生。43places基本上可以看作是一个翻版的43things,只是我们要填写的内容从希望做的事情变成了旅游地点,在每个用户的界面上都会有一张世界地图,对于你去过的地区,就会标成蓝色,而你想去的地方则是橘红色显示。不过它的地域划分职能到国家级别(美国除外),因此只要你去过中国的某个地方,整个中国都会被标记为蓝色。而在搜索中添加目的地时,43places会从flickr中搜索相关tag的照片显示出来或者显示用户上传的相关地点照片,颇为吸引人。 而更有趣的是,在这里你除了可以添加实际的地理地点外,还可以选择月球、火星这些星球,甚至是天堂和地狱,更有人还为地狱添加了地点,那就是Bob Jones University。 从43places也可以了解到各个旅游目的地的受欢迎程度,大家最想去的前五个地点是:澳大利亚、新西兰、日本、意大利和希腊,看来还是风光秀丽的大洋洲最为吸引游客。而中国则排在第25位,有270人想去,前100个最受欢迎的地点中的中国地点还包括香港、西藏与上海。而在已经旅游过的最受欢迎的地点也是香港版上有名(第28位),可见香港的确是中国最国际化的都市。 不过试用后,我也发现43places与我原先所想象的有所不同,根据文心在blog中的描述,我更加先入为主地将43places看作是一个分享有趣的旅游地点的网络应用,就像吾城十处(10 places of my city)那样。但现在的这个43places则完全是43thing的翻版,成了人们分享旅游愿望的地点,这样就造成其中大部分的地点都非常的宏观,比如在国家或者州/省/城市这个层面,而不是深入到具体的某个地点,从前100位最受欢迎的地点几乎数不出具体地点就可以证明这一点(不过从新添加的地点来看,这点似乎在逐渐变化,微观的地点越来越多)。而这样基于宏观层面的旅游愿望分享,在我看来,所带来的乐趣远远小于分享某个城市别具特色的地点所产生的乐趣。正如WebLeon所说像Plazes这样的服务要有趣得多。我并不需要数百人告诉我澳大利亚值得一游,我想知道的是澳大利亚究竟有哪些值得去的地点。现在看来,43places还不能够很好地满足我这个需求。 ps. 发现爱米网在两个多月前就推出有“添加10个属于你自己的地方”的功能。

It is clear that nothing excites reporters as much as a good prostitute story, especially one that manages to provide equal measures of titillation and indignation. Of course, it is usually the role of Western hacks to interpret the blossoming red light districts in China's cities in terms of the tired old "Chairman Mao will be turning in his grave" motif, but this week, Chinese journalists have been at it too, leading to no end of ridicule on the nation's online bulletin boards. The brouhaha, says the unerringly salacious Sichuan Online, arose from a number of media reports about prostitutes in the country's "old revolutionary base" of Linyi in Shandong. Apparently, a team of journalists were visiting Linyi, a "model city in the war of resistance against Japan", and were "embarrassed" by a number of unsavoury goings-on there. The BBS responses were generally very dismissive of these "over-delicate" hacks coughing into their handkerchiefs as they came across the sort of massage parlour, KTV joint and hairdressing salon that are, of course, quite typical of mid-tier cities like Linyi. "These reporters aren't stupid, so they are just hypocritical," said one reader. Another accused the reporters of "violating the privacy of the prostitutes". Curiously, the original article seems to have been taken down from all of China's mainstream news websites. The bulletin boards continue to buzz, however. Lin Daiyu and Jia Baoyu read some unhealthy literature.To prevent young minds from rotting away over the summer vacation, China Central Television has announced that over the next few weeks it will be broadcasting television adaptations of the four Great Classic Novels. Though the series, Dream of Red Mansions, Outlaws of the Marsh, Journey to the West, and Romance of the Three Kingdoms, have all been shown on television in the past, this will be the first time they are all broadcast together. CCTV producers point to series that claim to have an uplifting message but which are essentially standard teen-idol soap operas whose message is nothing more than "Forsake everything for love." And the "Red Classics" - patriotic war dramas - have neither the quantity nor the quality to make much of a dent in viewing habits. With such a gap in educational programming, CCTV must fall back on the old standards so as not to lead children astray. Ironic, then, that the most recognizeable image of Dream of Red Mansions, even in its bowdlerized CCTV version, is that of Lin Daiyu and Jia Baoyu reading Romance of the Western Chamber, a book that was considered unhealthy for children. The four series are in fact rarely ever off the air and form a staple of local TV station programming. So with three episodes airing every morning, this might just be a crafty plot to get kids to turn off the TV and do something more constructive with their time. Being the law abiding, straitlaced individual that you are, you may have not noticed that between June 20 and July 3, the Beijing Vice Squad clamped down on hundreds of fine entertainment venues in the city. According to today's Legal Mirror, 700 venues with problems (有问题的) were either fined or shut down after several types of irregular activities were discovered by the cops. To be specific, 'entertainment venues' included karaoke parlours, saunas, video arcades and hair salons. Irregular activities included prostitution, escort services, drug use and dealing, and operations outside the range of services fixed in the venues' business licences. Can't you tell that today Beijing is a better, cleaner city? 注:最近美国法院弄出不少事情,一个是这个判决,一个是关于时代和NYT记者的案子,一个是最高法院女大法官退休,值得大家仔细关注。其实台湾大法官会议最近也有一个惊人的判决,关于“临时处分”的,适当的时候我会写一下。下面转载的文字略去了英文段落。此篇文章作者“参数”也有自己的博客(http://scholar.tianyablog.com/blogger/view_blog.asp?BlogName=scholar),值得一看。

在讨论美国的政治的时候,很多人常常会把更多的焦点放在总统和国会,而忽略了最高法院的作用,然而,实际上最高法院的判决对于美国社会和政治的影响更加深刻也更加持久,明白了这一点,就不难理解为一个星期以前,美国最高法院就以5比4的微弱多数对Kelo v. City of New London案作出的判决是多么的令人惊讶和...恐惧。特别是在这个看上去美国社会在向“右”转的时代。

   New London是美国东北部康涅狄格州的一座小城市。在过去的二十年中,因为种种原因,这座城市的经济状况一直不好,1998年这个城市的失业率是全州平均水平的两倍,它的人口也降到了1920年以来的最低点。

   城市的官员们决心采取一些行动复苏小城的经济。为此他们实施了一系列的招商引资计划。在这样的背景下,他们决定对Thames River(泰晤士河?)畔一片90英亩的土地做一个规划,在这片土地上建设博物馆,健康俱乐部等等促进旅游业的项目,此外相当大的一片土地规划中是要给一个叫做Pfizer的医药公司建立全球研发中心。小城的官员们认为,这样的开发计划一定能够促进小城充分的就业,旅游的兴旺,经济的发展以及财政的增加。

   问题是在这片土地上有一些维多利亚时代的建筑,他们的主人有的在这里已经生活了上百年了,他们对这里存有感情,他们不愿意交出他们的家园,更不愿意把自己的家园卖给一间私人公司。为此他们把市政当局告上了法院,Kelo是他们的代表。这些居民的控诉依据很简单,就是美国宪法的第五条修正案: “ nor shall private property be taken for public use without just compensation”  中文一般翻作“不给予公平赔偿,私有财产不得充作公用”

   在这个案子里面,市政当局是把土地卖给私人公司的,这就不是public use,也就不能运用“eminent domain”来强征公民的财产。eminent domain精确的含义留待专业人士详解,我就不在这里班门弄斧。

   康涅狄格州最高法院驳回了他们的意见,支持了市政当局。走投无路的居民们向联邦最高法院上诉。联邦最高法院职责是处理和宪法相关的案件,因此它的判决就是当今的美国对于这古老神圣的宪法条文的最权威诠释。

   尽管首席大法官伦奎斯特持反对意见,法院仍然以5比4判决市政当局的强征不违反宪法。那些作出这样的判断的法官们,他们的核心意见是这样的: “it (court)has embraced the broader and more natural interpretation of public use as "public purpose.” 法院一直主张对“公用”应当作更自然和更宽泛的解释,比如解释为“公共目的”(而非仅仅公众使用??)

   描述完这整个的事件之后,不知道各位网友怎么想,我自己,热爱理性公正和个人自由的良心让我不能理解它们这样的结论。

   大概有相当相当多的专业或者非专业的书籍和文章都曾经讨论过美国宪法的这个条文,提到它对于保护公民财产的重要意义。天涯上丁林先生在他的《在边缘看世界》里的“阿灵顿和罗伯特·李将军” 一文以及前不久网上发表的“拆迁在美国”里面也间接地提到了宪法这一条的精神,和它表达的对于政府权力的界限和少数人生活安全的思考。

   如果这些学者们所赞美的是那样一座树立在汹涌澎湃的公众呼声和政府权力的浪涛面前保护普通百姓财产安全的大坝的话,那么这个判决就给这个大坝打开了一不大不小的洞。

   当然相信多数是喜欢这个判决的,在http://www.verylaw.com/ben/index.php?job=art&articleid=a_20041221_073924 中一位网友如是说:“一直拿着西方例子来批评的人,总是教导我们西方的有偿征收,必须是为了公共利益,像我国的那种制度是政府和房产商官商勾结,是商业开发,根本不是有偿征收 eminent domain。
  
   不过风水轮流转,今年到我家。人家老美现在也开始向中国人学习了,在最新的一个eminent domain的诉讼中,(Kelo v. City of New London, No.04-108), Connecticut州的最高法院就什么是公共利益public use做了中国标准的解释。”

   把这件事和我国的事情联系起来,人们只好三缄其口。 不过到底我觉得有必要也让大家看看那并不薄弱的少数派法官们是怎么思考的,个人觉得,他们坚持的才是最根本的。

   摘抄他们意见中的一些核心部分,请各位网友思考。我试着翻译一部分,算抛砖引玉吧,期待更专业、英文更好的网友斧正。

   当我们解释宪法的时候,我们是从一个朴素的假设开始的,那就是宪法中的每个词都有它自己独立的意思。......根据这个假设,我们发现第五条修正案的语言对于强制征用权的实践加上了两个不同的先决条件。征用必须是为“public use”而且必须对拥有者给予"'just compensation' . 这两项限制(当指“public use”和"just compensation")用来保护“财产不受侵犯”,它们合在一起就为财产的稳定所有权提供了保证,这是通过阻止政府对强制征用权过度,无常,或不公正的运用,这样的强制征用权特别可能会用来对付那些不能够在政治生活中对抗多数人的意志保护自己的财产所有者。public use的要求,相应的就设置了更加基础的限制,它把强制征收权“eminent domain power” 限制在一个特定的范围:政府可以为了公共用途迫使一个个人交出它的财产,但却不能为了另一个个体的利益这么作。

   哪里才是对财产公共或者私人使用的界限呢?我们给予立法当局对于什么样的政府活动有利于公众的判断给予充分的尊重。但是如果政治力量是对于公共和私人的区别的唯一仲裁者的话,那么Public Use条款就不过是一些动听的废话,一个对于公用要求解释的外部的,司法的检查,虽然是有限的,却是必要的。如果这个对政府权力的限制还有任何意义的话。

   今天法院(指多数派的决定)扩展了"public use"的含义,它认为当局可以把正在为正常私人用途使用的财产赋给一个新的私人的用途,只要这样的用途能够对公众产生间接的好处,比如增加税收,就业,乃至美学上的愉悦感。但是几乎所有合法的实际的私人财产都可以说成是对产生对公众有益的附带好处。因此如果预定(甚至可能仅仅是被保证)的积极附带效应就足以合宪地把财产从一个私人一方转移到另外一个私人一方地话,"for public use" 这样的话实际就没有排除任何这种强征,从而也就对强制征用权构不成任何限制。

   现在(判决出来之后),任何财产都可能为了另外一个私人一方的利益而被拿走,但是将要发生的事将不会是任意而为的。受益者将很可能是那些拥有不对等(比诸受害者)政治影响和权力的公民,比如大公司和开发商,对于那些受害者来说,现在政府有了把财产从那些拥有较少资源的人转到拥有更多资源的人那里去的合法执照。我们国家的创立者不会期望这样不公正的局面。

   不知道会不会有人和我一样对此一发生在大洋彼岸的案件感兴趣。但是它确实非常有意义。它警醒我们,即使在美国,对于正义和普通公民权利的保护的努力也总是处在进行时,而且会有暂时挫折的时候。

  其实, 对于宪法, 有两派之争. 一派是主张完全忠于原文. 另一派是主张给予广义的解释. 这个案子是后者的胜利.
  不久前, 亲耳听了前一派的代表人物最高法院大法官Antonin Scalia的演讲(演讲厅内外众多的示威者), 改变了我对他的很多看法. 以他的观点, 如果要改"公用"为"公共目的"的话, 必须要通过一个宪法修正案才行.
  昨天, 最高法院大法官 Sandra Day O'Connor 因为其丈夫的身体健康问题, 宣布退修. 布什在谈到继任人选是说, 他要提名一个保守的法官, 一个忠于宪法原文的法官.
  Sandra Day O'Connor 本身并是一个中间观点的法官. 在这个案件中, 她是在少数的保守一方. 如果新的法官是一个保守的法官, 应该对这类案件影响不大. 但对其它案件会有很大的影响. 不过如果较自由的85岁大法官John Paul Stevens如果在布什任内退休的话. 这类案子有可能会有不同结果.

  这个案子的影响及发展:
  1. 有8个州应该没有影响. 因为那些州法根本就不许因为经济原因来征用私产. 而且其它州应该也不敢多用. 因为选民有可能将那些人赶下台.
  2. 参议员John Cornyn提案, 限制广义定义public use. 不过这个法案就是成为法律, 也可能被判违宪.
  3. 一个喜欢搞政治的商人Logan Darrow Clements在6月25日,向Weare市政府申请,用最高法院大法官 David Souter(也就是这个案子的多数之一)的家那块地来建旅馆. 因为他是为了public perpose. ^_^.

Fake military plate backed with a genuine one.The ads posted around town read, "Put a license-plate frame on your car, and you won't have to pay tolls, parking fees, or traffic citations." The product was a James Bond-style license-plate flipper, letting drivers break laws with abandon using fake plates before swapping to a second set with the press of a button. The Q selling these things in Hepingli, a Mr. Song, was charging 4000 RMB (484 USD) for installation of an automatic version, and 2000 RMB for a manual version. A Beijing Daily Messenger reporter investigating the ads was able to talk him down to 800 RMB (the fake plate itself goes for 500 RMB or so somewhere near Dongzhimen). Good citizens that they are, one of the reporters pumped Mr. Song for information while the other called the cops on the guy. According to traffic law, he could be fined between 200 and 2000 RMB for faking or altering plates, and criminal law could throw him in jail for up to three years.
