在杭州一年了. 一年前的今天, 来到杭州. 那天真冷, 一年后的今天, 寒流来袭, 一样的冷. 这个冬天真的算是领略到了南方的冷. 武林城呆一年,学到的本地话有如下几句"不搭嘎", "搞不灵清"-- 我对杭州话就"不灵清", 还有一句骂人的"轮儿(62?)". 是听公司领导解释后记住的. 听到了好几次万峰老师的节目, 他是杭州的知名人士. 据说万老师怒了的时候就用杭州话骂人,没听过. 吃不惯杭州菜, 很想念北方的土豆与豆角, 还有干豆腐, 杭州有"千张", 做卤味用的, 用北方的吃法则一点滋味没有. 杭州人的热水器很少用天然气, 都是用电来烧.刚来的时候特别不习惯.还有些胆战心惊. 杭州出租车看上去大气,但最令人恼火的就是这出租车, 打不到出租车很正常,每天下班的时候最好别在路边等车--这个时候出租车交接班, 这在北京是不可想像的. 不过,大多数出租车司机也赚不到什么钱,动不动就开着车跑老家去了.

Richard Spencer, the Beijing correspondent of Britain's Daily Telegraph newspaper has a blog: Richard Spencer. Unfortunately, the URL is viciously anti-mnemonic so bookmark it if you like it.

The blog was found via the Danwei referral log. In his post, China's internauts find the kitten killer, Spencer ackowledges and links to Danwei. That's a nice gesture: it's becoming quite common to find, in mainstream media reports, translated phrases and information that could only have come from Danwei (and other China blogs); the source is rarely acknowledged.

前天在自己的blog上写了一篇关于摄影的文章。采用了flickr上面一个老外的照片。其实并非完全采用,而是我经过第三方的工具加工而成的一个拼贴图。自己还挺得意地给那个老外发去送了trackback。没想到过了一个小时不到,就收到了一个邮件:

Thanks very much for your essay, and for the attention you've paid to my work, along with sharing it with others. I have a concern, though, and that is the re-publication of my work on your website without permission. I'd like to ask that you take it off your site. It's fine to include a link to my Flickr page, but I'd like to control the rights to my own work a little more carefully.

第一感觉甚至不是感到委屈,而是非常意外,难道flickr上的图片不是可以随便转载的吗?当时并没有多想,就写了个道歉的信回复那位老外,然后撤下照片。因为他是一个在上海的记者,我想恐怕记者就会比较敏感吧。大概过了几个小时,又收到了他的回复:

Thanks very much. I appreciate your interest. Whatever one thinks of it, I've worked very hard on my photography, and can't let it be published at will.

事后自己越想越觉得委屈,好像是做了小偷给人发现一样,而且还是自己亲自去报告人家的-___-。一方面可能是因为对方的语气比较直(我甚至觉得不是盛气凌人),另一方面实在因为第一次碰到这种事情,觉得心中郁闷说不出的感觉。

事后回想,产生了几个疑问:

1.把照片上传到flickr是否意味着放弃某种权利?是不是意味着强制接受CC协议呢?
2.我对于原作的再创作是不是一种侵权?我有多大的权利对于原作进行修改?
3.使用过flickr的朋友们都知道,在大多数的照片上,都有“blog this”的小按钮,这是不是意味向其 他用户提供这样一种权利就是把这个照片进行转载------而无须通知原作者呢?
4.第三方的工具,比如我使用的fd's flickr toys,进行的操作,损害了原作者的权益吗?


于是自己对于这几个问题进行了考察。我发现,在flickr中对于照片的privacy选项有许多。但是默认的所采用的版权是All Rights Reserved。也就是说如果一个用户什么都不改动,那么他/她对于自己的照片拥有完全的权利。除此之外,你还可以选择CC(Creative Commons)的一系列授权。所以说,如果在ARR的情况下,原作者的所有要求都是可以接受的(当然。如果是CKG同志的话……)

然后我就第二和第三个问题向flickr的客服进行了询问,他们给我的答复如下:

I'm sorry but as it is his photo, he still holds the rights to it, so if he has asked you to remove it, I would do so. Adding his photos to a mosaic in order to use them in that fashion wouldn't be appropriate without his permission either.

看来根据flickr的认定,不管是否进行加工,照片的权利都是属于原作者的。所以我也只能按照他的要求做。

当然,现实的问题是,大多数人并不会像我这样神经兮兮地TB原作者,所以我想绝大多数侵权情况都不容易被察觉。但是问题是,一旦察觉,作者有什么办法去追讨自己的应有权益,而像我这样的用户如果耍无赖的话那又怎么办呢?这个问题一旦铺开就很复杂了,因为牵涉到这个制度设计的问题以及追讨的成本问题。同时,如果我们把它作延伸的话,馒头案和我的这个小尴尬是不是也有几分相似呢?

如果再做进一步的延伸,恐怕就触及到“版权”这个敏感的问题了。而这个案例的意义在于,我认为,那就是我们大家都有可能成为被侵犯权益的人。不管是你的照片,你的文字,无一不是如此。当然我想更多的情况是我们并不会在乎小小的引用行为。

最后说一下flickr,尽管我对于它的“blog this”按钮仍然耿耿于怀,因为这在我看来简直是对用户的某种纵容。但是值得称赞的是,flickr仍然把用户的利益摆在很高的位置,并没有因为你是我的用户,就在用户同意条款里面加入霸王项目。相比国内的某些服务商,是不是更值得我们学习?

希望这个小小故事对大家有启发。

Though it's been a while since Danwei looked at Beijing's bestselling books, there have been few drastic changes. Regular readers of this feature will probably not be surprised to learn that this week's overall bestseller list is populated primarily by novels, with management and celebrity-related books making an appearance as well.

This week we look at Narnia novels and movie tie-ins, Lei Feng and his champion, and how Brokeback Mountain is sneaking into the libraries of mainland readers.

The Lion, the Witch, and the Wardrobe opened 8 March on the Chinese mainland, but Narnia fever has been going on for several months. The seven novels appeared in December in a 99-yuan set (a relative bargain next to the 166 yuan the five Harry Potter novels would run you), which tops the children's list this week. The books occupied a high position on the children's bestseller list in an environment where C.S. Lewis is little-known. Put out by Yilin Press in 2001, they sold fewer than 10,000 complete sets in five years. The new editions have sold 20,000 sets in just two months. Yilin should probably be commended on its astute judgment of the demand created by the market for pirate DVDs.

But Yilin's version is not the only one out there. Disney, in association with Lijiang Publishing House, released a novelization of the film as well as a series of episode-specific movie photo-books. The tie-ins are notable in that the text is accompanied by pinyin transcription for younger readers. Disney has published such books before; its classic fairy-tales have been annotated much in the same way that its classic cartoons are repurposed as English instructional materials. But it is still fairly rare for pinyin to accompany something more up-to-date than Sima Guang Breaks the Jar or Cao Chong Weighs the Elephant.

New this week is a biography of Lei Feng. At #6 on the list, Lei Feng Spirit (the title translates as Lei Feng 1940-1962) benefits from last week's observance of Lei Feng Day as well as a promised cache of 200 previously unpublished photos of the hero. Text on the cover reads, "Everyone is searching for their own Lei Feng. The country is searching for its own Lei Feng."

In non-bestseller news, a series of translations concerning Mao and Chinese Communist Party history have appeared on shelves in academic bookstores of late. Headed by Mao: A Biography by Ross Terrill, the "International Mao Zedong Studies in Translation" series commemorates the 30th anniversary of the death of the Chairman, and includes such names as Maurice Meisner, Frederic Wakeman, Jr., and John Bryan Starr. These are reissues of earlier publications in illustrated editions, brought together by Renmin University Press under uniform red covers emblazoned with famous Mao head shots.

The cover also reassures readers that although these texts have been translated in full, they have also been "examined and approved by the documents office of the Central Committee."

What has not been examined and approved is the Chinese translation of E. Annie Proulx's Brokeback Mountain. The film won't be screened on the mainland, and it was reported this week that the book is not coming out in Chinese "for the time being."

People's Literature Press, which published Proulx's novel That Old Ace in the Hole as part of a series of 21st Century foreign literature, bought up the mainland Chinese rights to the short story collection containing Brokeback Mountain. According to Beijing Daily Messenger, PLP first intended to take advantage of the growing attention to the film version and bring out the collection sooner than expected. However, it soon reconsidered, and said that it would "publish an expurgated version." Later, reports said that it "at present had not decided not to publish," with the reason assumed to be that the subject matter was to sensitive.

Since "for the time being" has not been explained in further detail, fans of the book have taken it on themselves to translate the story, just as fans of Harry Potter translated volume 6 while People's Literature Press took its time. PLP is not overly concerned at the moment, probably because it is busy preparing Proulx's The Shipping News for release at the end of May. The translation is being done by Ma Ainong, who also did Harry Potter #6.

随着Blog技术的发展,越来越多的信息以RSS的形式发布,可定制自己阅读列表的聚合器(Aggregator)逐渐得到普及。从分散式的发布到个性化的订阅(聚合),一个完整的信息流动链条已经形成。

但是信息过载(Infomation Overloading)正在逐渐困扰人们。设想一下最初你只订阅了几个Blog,每天你只要化几分钟来阅读;随后你发现了越来越多有趣的Blog,你把它们一个接一个地加入到你的订阅列表中;于是你的订阅列表变得越来越长,每天阅读的时间也越来越多;终于你无法忍受这样过多的信息轰炸。这就是信息过载。

近来,“过滤器”(Filters)、智能化的聚合器被越来越多的文章提到。

人们也在研究如何提高聚合器的阅读体验:

我看到的解决办法有两类:基于关键字的本地过滤器和基于社会化方法的过滤器。

基于关键字的本地过滤器:象BlogBridge 这样的聚合工具已经支持这种过滤器了。你可以设定自己感兴趣的关键字,而且BlogBridge也在积累和使用个人阅读Feeds的数据。相信在这方面还有很多工作可以继续作。

基于社会化方法的过滤器:点击 http://del.icio.us/popular/ ,你会获得大量的高质量信息,这是利用社会化途径过滤信息的一个良好例子。这种途径蕴涵着更多的商业机会。

Google Operating System的Blogger对这副图发表了看法,并指出其意义即在于群体智慧。这个图是日前Google 2006 分析日演示中的一页,当时看到时也不明白为什么要配个牛在上面,现在知道了:

话说19世纪时,有位英国的人类学家跑到一个大集上找了800人,让他们估计一头牛的重量。这里面大多数都是普通人,当然也有屠户和牧场主这样的专业人士。实验得出的结论是800人估测的平均结果比任何一人的结果都要好,也就是群众的智慧要比专业人士还高。

这一结论在其后多次被验证,从市场预测到公共管理。作者最后说,他在Google学到的一点就是:一家公司不会比该公司产品的用户更聪明

延伸阅读到Wikipedia--再次说明这一资源是多么得宝贵--群众的智慧,这里详细解释了这种理论:

群众智慧的类型有三种:认知,如市场评测更快更可靠,也不易受政治因素影响;行为协调,如饭馆的最优化使用,拥挤的交通中避免碰撞等等;合作,即在有信任网络但没有中央控制的群组内,人们可以做得很好。

最后一条显而易见是支持自由市场原则的。同样,在开源界也存在这种互相信任而没有中央控制,同样开源界工作得也很好。

群众智慧的形成要有四个因素:观点多样化,每个人都有自己的信息,不管它多怪;独立,每个人的观点不受他人的影响;分散,每个人都有自己的领域;聚合,即有一种有效的把意见集合起来的机制。

群众智慧的失效也有几种可能:第一是过于中心化,如哥伦比亚航天飞机失事被认为是NASA的管理太过官僚,不能听取低级工程师的建议;第二是太过分散,如美国911事件的发生被认为是情报部门不能合作,不能交流信息而导致的,所以他们后来成立了一个部;第三是模仿性太强,如参与者要逐一做出选择,后来者就容易受到前人意见的影响。

很明显地,要想群众发挥他们的智慧,就必须有足够独立的群众,充分的信息获取渠道,以及让他们发表意见的通路。在这种情况下,群众足以做出比任何精英更好的结论。如果这些精英要想自己主导,他们就只能压制这三种可能,不让独立精神形成,不让群众有获取信息的渠道,不让他们随意说话。

反映到公司和产品上,如果公司不信奉这个,就会把用户当傻瓜,强奸他们的电脑,完全不理会用户不想看广告满天飞的诉求,不但不听,还发钱请枪手写软文夸自己的垃圾功能是多么的强大。

当然,这群众智慧似乎也只在社会领域,科学领域内意见再多,也不能否认1+1=2;宇宙是什么样子,怎么起源的,宁肯不知道,也不能由投票决定。
